AVAILABILITY
We list availability information for products sold by us on the website, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Our dispatch times are not guaranteed and should not be relied upon as such. Despite our best efforts, a small number of the hundreds of products in our catalogue may be mis-priced. If a product’s correct price is lower than our stated price, we charge the lower amount and send you the product. If a product’s correct price is higher than our stated price, we will charge the lower price.
PRICING
The price for the products will be:
– the price in Australian dollars excluding Australian GST; and
– as quoted on the Site at the time of placing your order.
We may alter the prices of the products at any time without notice.
TAX
Prices are exclusive of Goods and Services Tax. In all other respects, the price is also exclusive of taxes, duties or charges imposed or levied in Australia or overseas in connection with the supply of goods and services. GST will be applied at checkout.
ORDERING
You must:
– Only order Products in accordance with the instructions on this website; and
– Pay for the Products in full upon receiving an official invoice
While we will endeavour to fulfil your order, we will not be liable to any person if we decline to fulfil an order, or we are unable to supply the Products in your order. No contract for sale and purchase of Products will be formed, or variation or cancellation made, until we confirm acceptance of your order, variation, or cancellation. Some Products may be unavailable from time to time. We reserve the right to alter, upgrade or discontinue any Product or information contained on the Site without notice.
We may cancel orders if we believe that they are fraudulent, or if an error has occurred including, without limitation, listing with an incorrect price or information.
All Transactions will be charged by “Pilbeam Living Pty Ltd”.
TRADING TERMS
If you are placing your first order with Pilbeam Living, we will put your account on a proforma basis. This means we will require full payment of the invoice prior to despatching the goods.
The most efficient way to make this proforma payment is by calling us 03 9417 5755 and providing your card details over the phone. We accept both Visa and Mastercard and do not charge a processing fee. If you would rather make payment via EFT, please note our account details below:

Please use your invoice number as a payment reference so we can match the payment to your order.
Upon completion of your first proforma invoice, we ask that you complete our Credit Application Form should you wish to be considered for a 30 day account.
Credit accounts are available to customers who have successfully completed their first proforma order and Pilbeam Living has approved the returned Credit Application form. Once you are on a 30 day End of Next Month account, this means all invoices must be paid in full by the end of the month following the month of the invoice.
MINIMUM ORDER VALUE (EXCL. FREIGHT & GST):
– Trade fairs (all customers) – $500
– Existing customers at all other times – $350
– New customers at all other times – $500
For us to send out backorders, please note that the minimum order requirement is $150 pre-GST and excluding freight charges.
All prices on our website are shown as GST exclusive, but please note that GST is charged on all invoices.
COLOURS
We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, due to monitor discrepancies, we cannot guarantee that your display of colour will be accurate. If you have any questions or concerns about colours, please contact us via our contact page.
ELECTRONIC COMMUNICATIONS
When you visit the website or send emails to us, you are communicating with us electronically. We communicate with you by email or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
ALTERATION OF SERVICE OR AMENDMENTS TO THE CONDITIONS
We reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and Conditions of Use & Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
EVENTS BEYOND OUR REASONABLE CONTROL
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
INDEMNITY
You agree to indemnify and keep us indemnified against all loss (including, without limitation, loss of profits), costs, damage, expense or injury, whether direct, indirect, special or consequential, arising directly or indirectly from, or in connection with, your access to, or use of, the Site, or the supply or non-supply of Products.
You further agree to indemnify and hold us harmless from any claim or demand, including legal fees on full indemnity basis, made by any third party due to or arising out of:
– a breach of these Terms by you; or
– the infringement by you, or another user of the Service using your name and password, of any intellectual property or other right of any person or entity.

TRADING TERMS
If you are placing your first order with Pilbeam Living, we will put your account on a Proforma basis. This means we will require 10% of the value of the order to be paid prior to despatching the goods as well as a completed Credit Application Form. Upon completion of your first Proforma invoice and once we have approved the returned Credit Application Form, you will be put on 60 Days End of Month payment terms.
All NZ sales to be paid by EFT only. Credit card facilities are currently not available and will be available by the end of June 2023.
